Eden Island Luxury Accommodation Terms & Conditions

The following conditions apply to all property rentals booked pursuant to these terms between Eden Island Luxury Accommodation (referred to as “EILA”) and all occupants of properties in the Eden Island Luxury Accommodation portfolio (referred to as “The Client” ”).

  1. Bookings, Confirmation and Payment Terms

    All bookings made and accepted are provisional and only confirmed upon receipt of payment. A 50% deposit is required in order to confirm a booking, with the balance being due 30 days prior to arrival. When the booking dates are less than 30 days from the date of booking, full payment is required to confirm the booking. Payments can be made via SWIFT bank transfer into EILA’s bank account or via a credit card (Master or Visa). All booking payments are to be nett of bank charges.

  2. Check In & Checkout

    Unless otherwise agreed to in advance and in writing: Check-in time is 14h00 on the day of arrival. Check-out time is 10:00 on the day of departure.

    EILA may at its sole discretion charge an “early Check-In” or late Check-out” fee.

  3. Premature Departure

    If a “The Client” departs earlier than the booked departure date, irrespective of the reason or cause for the early departure, no refunds in respect of unused days shall be made to “The Client” ” by “EILA”.

  4. Late Arrival

    If a “The Client” arrives later than the booked arrival date, irrespective of the reason or cause for the late arrival, no refunds in respect of unused days shall be made to the “The Client” ” by “EILA”.

  5. Cancellations/Amendments

    All cancellations are to be in writing and emailed to reservations@edenisland.sc

    EILA will acknowledge receipt of your cancellation via email or fax. It is the “The Client” ’s responsibility to ensure that written notice of cancellation has been received by EILA by obtaining written acknowledgement thereof.

    Cancellation charges/penalties are effective from the date of receipt of written notice by EILA and are as follows:

    30 days or more prior to arrival – full refund

    15 - 29 days prior to arrival – 25% of total booking as a cancellation fee

    8 – 14 days prior to arrival – 50% of total booking as a cancellation fee

    7 days prior to arrival – 100% of total booking, no refund

    All bank and/or credit card charges relating to a refund to “The Client” ” shall be to the account of “The Client” ”. Any waiver of the above policy, be it in part or totality, irrespective of the reason causing such cancellation, shall be at the absolute and sole discretion of EILA.

    As such, EILA strongly advises all clients to obtain adequate and appropriate travel and personal insurance cover.

    Amendments to a confirmed booking, whether in property size or type, arrival and/or departure dates or resulting in the shortening of a booking may be subjected, at EILA’s sole discretion, to the applicable penalties as detailed in the section headed Cancellations.

    Cancellations and/or amendments to a booking caused either by Force Majeure, including but not limited to natural disasters (earthquakes, floods, cyclones, tsunamis, volcano eruptions) or major upheaval (acts of war, acts of terrorism, riots) or caused by a transport carrier, including but not limited to technical problems, labour strikes or flight delays, shall not be immune from the applicable cancellation and amendment penalties.

  6. Housekeeping

    Housekeeping is provided on a daily basis unless otherwise agreed to at the time of booking.

    Housekeeping times and work schedules are at the sole discretion of EILA. As such, all “The Client” s are requested to not turn away the cleaning staff as this could result in the property not being serviced.

    EILA will as far as possible try and accommodate any specific cleaning time requests. As properties are fully equipped and rented on a fully self-catering basis, housekeeping staff work to a specific schedule. Washing, drying and ironing of “The Client” s’ personal clothing is not included in the housekeeping service.

    Bed linen is replaced every 3 days of a continuous stay. Any requests for additional or more frequent service will be charged to the “The Client” .

    Please note that all washing, drying and ironing of linen and towelling will take place in the property.

  7. Accommodation Changes

    In exceptional circumstances EILA may be forced to cancel a confirmed reservation of a property due to unforeseen damage or emergency repairs. In these unlikely events EILA reserves the right to either cancel the booking, providing the “The Client” with a full refund of the booking value or allocate the “The Client” a different property to the one originally booked, providing that the replacement property is at least equivalent to the property or property category originally booked.

    EILA shall not be liable or responsible for any loss or expense incurred by the “The Client” as a result of change in property or cancellation of a booking.

  8. Conditions of Use of Properties

    Occupancy of a property is restricted to the number of beds and sleeper couch, if applicable, in the specific property. All occupants are to be bona fide guests as detailed at the time of booking. Additional guests, not specified in the original booking, may, at EILA’s sole discretion, be charged an additional fee per night, equivalent to the property’s daily/nightly rate divided by the number of beds in the particular property.

    Sub-letting of a property to any third party is strictly forbidden and will result in the cancellation of the booking and subsequent expulsion of the occupants.

    As Eden Island is a secure estate, access and use of a rented property and the common use areas, including the various leisure facilities, is restricted to “The Client” s as detailed in the original booking. No access to day visitors or invitees of “The Client” shall be allowed unless prior arrangements with EILA have been made.

    All properties are rented on a Self-Catering basis and are fully furnished and equipped. No items belonging to a property may be removed from such property or its exclusive use area. All properties are rented as strictly “Non-Smoking” inside the property. Any occupant found in breach of this condition shall be forced to vacate the property and be liable for all costs associated with restoring the property to a non-smoking status – including but not limited to sanitizing and dry cleaning of curtains and all fabric covered furnishings.

    A four seat EPV (Electric Powered Vehicle) is provided and included in the rental rate of each property. Irrespective of the number of guests occupying a property, and is provided strictly according to the EPV Use Rules detailed below in this document.

    Due to the high humidity in the Seychelles, clients are requested to refrain from using the air condition systems whilst windows and/or doors are open in the property.

    All refuse is to be placed in the appropriate refuse bins located in the dedicated areas of each property.

    Swimming or fishing in the basins or waterways is strictly forbidden.

    Occupation and use of a property is subject to adherence to the rules of the Eden Island Village Management Association (VMA), the most pertinent of which are included in these Terms & Conditions. A copy of the full VMA Rules can be provided on request.

  9. Use of EPV (Electronically Powered Vehicle)

    EPV’s are to be treated as normal vehicles. The right of use thereof is conditional on, inter alia, the following rules:

    1. Seating capacity is limited to the number of seats (4). Overloading of an EPV is strictly forbidden and “The Client” s are requested to make multiple trips where more than 4 guests are occupying a property.

    2. Seychelles road rules are keep left despite EPV’s being left hand drive. Take caution not to veer off to the right hand side of the road thereby potentially causing an accident with an oncoming EPV. Traffic circles are to be used in a clockwise direction giving way to traffic approaching from the right.

    3. Please be aware of pedestrians, particularly children, who also make use of EPV roads.

    4. Please do not drive of park on the lawns or on the beaches.

    5. Driving of an EPV is strictly limited to persons over the age of 18 and someone who holds a valid driver’s license.

    6. Take care when using rain covers as if not properly secured these can flap and either injure pedestrians or catch on trees or other passing EPV’s.

    7. Driving under the influence of alcohol or any intoxicating substance is strictly forbidden.

    8. Always use extreme caution and common sense when driving an EPV.

    9. Failure to comply with the above rules may lead to a fine being imposed and confiscation of an EPV.

    10. Damage caused to an EPV or its equipment shall be the sole responsibility of the “The Client”, irrespective of the circumstance which may have caused the damage.

    11. In the event of an accident please report immediately to the VMA Call Centre (+248 434 6111) located at the entrance to the estate. In such cases “The Client” s are responsible for repairs to damage caused to their EPV, irrespective of the party responsible for the cause of an accident.

    12. EILA shall not be responsible or liable for any damage to an EPV or injury to a passenger caused by an accident, irrespective of the circumstances.

    13. EILA strongly advises all clients to obtain adequate and appropriate travel and personal insurance cover.

  10. Landscaping & Swimming Pool Services

    Regular landscaping and swimming pool cleaning services are undertaken by outsourced parties to the VMA.

    EILA shall not be responsible or liable for any inconvenience that may be caused through the supply of these services.

  11. Security breakages & Damages Deposit

    EILA reserves the right to determine, in its sole discretion, based on factors such as duration of stay & number of guests, the amount of deposit required as security for the property and contents against damage, loss and/or breakages.

    Except in the case of normal wear and tear, the “The Client” shall be responsible for any damage, breakages or loss caused to the property or its contents, whether such damage, breakages or loss was caused accidently, through negligence, wilful default or irresponsible behaviour on the part of the “The Client” of any of the guest occupying the property.

    EILA will inspect the property following departure of the “The Client” and in the event of any damage, breakages or loss, shall communicate this to the “The Client” within 5 days of departure. Where damage, breakages or loss has been found, the replacement value therefore will be charged.

    Should it be established that any damage, breakage or loss has occurred, the “The Client” accepts responsibility and agrees to indemnify EIRPMC for such damage, breakages or loss and agrees to pay all the costs of repair or replacement of such loss, including costs of recovery, legal costs, court costs and other expenses if required.

  12. Property Maintenance & Disruption of Services

    EILA will utilize its best efforts to provide accommodation in properties that are fully functional. Occasionally emergency, remedial or preventative maintenance is undertaken to properties on Eden Island and EILA shall not be held responsible or liable for any disruption any of these services may have on a “The Client”. Any appliance or items of equipment that is found not to be functional must be reported to EILA’s management who will endeavour to have its repair attended to as soon as possible. EILA shall however not be responsible or liable for any item of equipment and/or appliance that is not functional, nor for any inconvenience caused as a result thereof.

    “The Client” s are advised that due to the limited availability of spares and/or service staff in the Seychelles generally, there is no guarantee that any appliances or equipment requiring repair will be undertaken in a generally acceptable time frame.

  13. Limitation of Liability

    EILA shall not be responsible or held liable for any incident that results in personal injury, loss of or damages to any property of any “The “The “The “The “The “The Client” or person occupying or visiting a property or any of the facilities at Eden Island.

    Use of a property or any of the facilities, including but not limited to beaches, swimming pools, gymnasium, boardwalks, jetties, walkways, EPV roads of any other facility on the island is done entirely at the “The Client” ’s risk and the “The Client” hereby indemnifies EILA from any claims arising therefrom.

    All vehicles parked on Eden Island are done so at the risk of the “The Client” .

    Acceptance of a reservation with EILA indicates acceptance of these Terms and Conditions or any amendments which EILA may change at any time and without notice.

    Whilst every effort will be taken by EILA in allocating a suitable property to the “The Client”, the clients are advised that building and/or construction work is underway on various parts of Eden Island. This agreement is governed by the laws of the Seychelles.
